Dealer Stability
Where the establishment of a new motor vehicle dealership would have no effect upon the provision of service to purchasers of the manufacturer's products but would have a significant and adverse effect upon the stability of an existing dealership, the new dealership should be precluded from opening. Decision: 4 N.J.A.R. 385
Where establishment of a new dealership would have a detrimental effect on the provision of stable, adequate and reliable service in a defined market area, the new dealership should not be permitted to open. Decision: 5 N.J.A.R. 481
