Batching Cycle
Those who fail to gain a certificate of need within a batching cycle should either appeal that approval, as well as seek leave to appeal the denial, or withdraw from the batch and reapply in a subsequent batch; administrative hearing will not review comparative merits of applications approved within the batching cycle. Bed Need
Current occupancy needs may not be relied upon to determine bed need. Decision: 9 N.J.A.R. 001
Where no reason has been offered to depart from the standard methodology incorporated in regulations for projecting long-term care bed needs, no such department may be allowed. Decision: 9 N.J.A.R. 001
Defined
Administrative law judge determines what extent of physician control is distinguishing characteristic between a health care facility and a physician's private practice. Agency rejects, finding that this is only one of the factors to be considered in determining if center is a health care facility; influence and role of management company is of equal importance. Decision: 7 N.J.A.R. 262
