- Builder's Remedy Builder's remedy is appropriate only when a municipality demonstrates recalcitrance or repeated inability to provide a legitimate affordable housing plan. A builder is not automatically entitled to the remedy because the builder initiated a Mt. Laurel lawsuit. Decision: 12 N.J.A.R. 781
