Access
Grant of access by a court entitles cable television company to access to residential development unless physical conditions make access impractical or the possibility of technical incompatibility exists. Decision: 11 N.J.A.R. 486
Arbitrary Denial
Failure of a municipality to have a stenographic record made of its proceedings reviewing cable television contracts and to issue a written report detailing its reasons for selection results in an arbitrary denial of a municipal consent. Decision: 4 N.J.A.R. 260
Municipal Ordinance
Where an ordinance granting a municipal consent to a cable television company is approved by the State Board of Public Utilities it becomes binding on both the applicant and the municipality, is in the nature of a contract and the parole evidence rule is applicable. Decision: 5 N.J.A.R. 075
