Washington Township, Gloucester County, Board of Education of; F., G., A Minor By His Parents & Natural Guardians v
Formats: PDF | DjVu— Help viewing DjVu Files
Citation: 1 N.J.A.R. 55
Decision Date: 1979
Synopsis: Long-term suspension of student by Board of Education for allegedly smoking marijuana violated the student's due process rights where the school authorities failed to notify him in writing of the following: charges to be heard against him by the Board; a list of witnesses to be called in support of the charges; his right to cross-examine the witnesses; his right to enter his own defense; and his right to counsel. Though G.F.'s due process rights were violated by the Board's action, the Board's voluntary reinstatement of him to regular school enrollment during the administrative hearing and the expungement of all notations concerning the incident preclude a requirement of further action. D. Ellen Stimler, Esq., for Petitioner William D. Hogan, Esq., for Respondent (Hyland, Davis & Reberkenny, Attorneys)
