- Synopsis: Petitioner's tenure rights were not violated when the board of education transferred him from the position of elementary school principal to secondary school principal in the same district. Although the principal did not consent to the transfer, he was certified as a principal and qualified to serve in either position and had acquired tenure in the system as a principal per se. Since his compensation was not reduced and the acquisition of tenure was per se, the board could exercise its long-recognized right to laterally transfer a principal. Gerald M.
