Synopsis: The Election Law Enforcement Commission issued a complaint against the Hunterdon County Democratic Committee and its trea- surer for the late filing of its annual contributions and expenditures report. The administrative law judge assigned to the case determined that there were no factual matters in dispute; however, the treasurer ar- gued that he was not individually liable for the penalties imposed under N.J.S.A. 19:44A-22. The judge concluded that since N.J.S.A. 19:44A-8 requires that the treasurer certify the correctness of the report that certification would have to be in a timely matter. Since the certification was not performed in a timely matter, both the commit- tee and the treasurer were held responsible for the late filing.
