- Decision Date: 1983
- Agency: DEPARTMENT OF EDUCATION
- Synopsis: Petitioner, a high school graduate, and his parents sought an order requiring the Board of Education to identify all the pupil records it had maintained and, further, sought to have all records destroyed except those required by law to be maintained. Petitioner also sought a determination as to who had been given access to the records. The administrative law judge assigned to the case found that the school administration's files contained sufficient documents to render both files pupil records. The judge ordered the Board to search its files for any pupil records and forward copies of these records to petitioner's parents. The Board was ordered to destroy all pupil re- cords unless they were required to be maintained in perpetuity or where being held for the purposes of litigation.
