Synopsis: The Division of Gaming Enforcement sought a determination that Comdata Network Inc. and Western Union were casino service indus- tries subject to licensure under N.J.S.A. 5:12-92a and that the trans- actions conducted among Comdata and Western Union and the casino 11otel were prohibited by N.J.S.A. 5:12-101. The administrative law judge found that the involved companies electronically wire money to their customers who are patrons of the casino hotel and holders of selected credit casino. Both companies change a fee for this service and also pay a fee for each transaction to the casino hotel. Neither company makes.a loan or provides an extension of credit during the transfer. The judge determined that both companies were subject to licensure under N.J.A.C. 19:43-1.2(a)l.iv which requires licensure of services incident to casino activity. In addition, the judge determined that the services provided by both State of New Jersey 189 companies constituted an extension of credit in violation of N.J.S.A. 5:12-101. and were thus prohibited.
