Citation: 5 N.J.A.R. 419
Decision Date: 1979
Agency: TEACHERS' PENSION & ANNUITY FUND
Synopsis: Petitioner appealed from a decision of the Board of Trustees of the Teachers Pension and Annuity Fund denying him continued member- ship in the fund. The administrative law judge assigned to the case found that peti- tioner was employed as Director of Community Adult Education and Principal of the Adult High School for the Bound Brook Board of Education. The judge noted that N.J.S.A. 18A:66-4 limits emrollment in the fund to 'teachers' but that the definition of teachers set forth in N.J.S.A. 18A:66-2(p) would encompass the position held by peti- tioner. Accordingly, the judge concluded that petitioner was eligible for membership and ordered him continued employment. Louis C. Rosen, Esq., for petitioner Stacy L. Moore, Jr., Deputy Attorney General, for respondent (John J. Degan, Attorney General of New Jersey, attorney)
