Synopsis: The Division of Motor Vehicles sought to suspend respondent's New Jersey driver license based upon his conviction in the State of New York on a charge of operating a motor vehicle while impaired by the consumption of alcohol. The administrative law judge determined that the New York convic- tion for driving while impaired is substantially similar in nature to New Jersey's offense of driving while under the influence of intoxicat- ing liquor under N.J.S.A 39:5d-4(c) since both statutes have as their principal focus the competence of a driver to operate a motor vehicle safely. Accordingly, the judge ordered a suspension of respondent's driving privileges pursuant to N.J.S.A 39:5d-4.
