Synopsis: The petitioners, owners of a new home built and sold by the respon- dent filed a Notice of Claim under the New Home Owner Warranty Act, N.J.S.A. 46:3B-1 et seq. because of alleged defects in the construc- tion of their home. The administrative law judge assigned to the case found the con- struction defects existed in the home and that all of these defects were covered by the act and were below the minimum standard fixed by the act. In addition, the judge found the respondent had failed to do repair work at the owner's request and had defaulted at the adminis- trative hearing. Accordingly, the administrative law judge ordered that respondent, or in the alternative the New Home Warranty Security Fund pay all repair costs.
