Synopsis: In March of 1979, the petitioner submitted an application to the Department of Environmental Protection for approval of construction of a mobile home park. The agency denied the application based on anticipated nitrate production in excess of the existing standards. The administrative law judge assigned to the case found that peti- tioner undertook a testing program in October of 1980 to challenge the agency's unpublished standard. The judge found that the testing had taken place without the agency's knowledge and that it failed to meet acceptable scientific standards.
