Synopsis: Petitioner sought relief from the decision of a local county welfare board denying her AFDC and Food Stamp benefits on the ground that she possessed excess resources over the personal allowance of N.J.A.C 10:82-3.1(d) and 10:87-4.13(a)2. The administrative law judge found that petitioner and a next door neighbor held a checking account as joint tenants with right of survivorship. The judge found, however, that the account was opened solely with the neighbor's money and that petitioner's name was placed on the account solely to accommodate the neighbor who, being elderly and inform, needed assistance in paying his monthly bills. Accordingly, the administrative law judge concluded that the rela- tionship of the petitioner and her neighbor was that of trustee- beneficiary and that the checking account should not have been desig- nated a resource of petitioner.
