Synopsis: The Division of Motor Vehicles proposed to suspend respondent's driver's license for two years because he violated N.J.S.A. 39:4-56.5 by abandoning a motor vehicle. The administrative law judge assigned to the case found that respon- dent had been previously convicted of the offense in municipal court and was thus collaterally estopped from relitigating the issue. The judge determined, however, that in light of the punishment respondent had already received along with the circumstances surrounding the offense, the proposed suspension was unnecessary. Since the judge found that respondent had not abused his driving privileges, no license suspension was ordered.
