Synopsis: Petitioners alleged that the Elmwood Board of Education failed to compensate equitably the coaches of girls' sports and the coaches of boys' sports. The administrative law judge found that the coaches of girls' bas- ketball, softball and field hockey performed substantially the same duties and had substantially the same responsibilities as coaches of comparable boys' sports for the years 1973 through 1980, but that the coaches of the girls' teams had been paid less. The judge determined that any wage differentials for those years must have been determined on the basis of the sex of the students coached and was thus impermis- sible discrimination. The judge concluded that coaches were entitled to equal pay where equal duties were performed. The administrative law judge determined that retroactive back pay, limited by the six year statute of limitations contained in N.J.S.A. 2A:14-1, was the appropriate relief for those years where the duties and responsibilities of the coaches were substantially equivalent, and she so ordered.
