Synopsis: This action was brought to determine the rights of the teachers and administrators released from their positions with Central Regional High School District as a result of the withd}awal of Lacey Township from that District effective July 1,1978. The administrative law judge found that N.J.S.A. 18A: 13-64 protected the tenure, seniority, pension and leave of absence rights of all individuals employed by the Central District on the effective date of withdrawl. The judge found that the employees of the Central District on the effective date of the withdrawl should be transferred to equivalent positions in the new Lacey Township School District based on a seniority list created for purposes of effecting such a transfer. The judge directed that the Ocean County Superintendent of Schools meet with the parties to determine the seniority status of the individuals involved and to effectuate and equitable transfer. Nontenure employees who had received unsatisfactory performance ratings were found to have no claim to positions in the new district. The judge also ordered that any benefits afforded by the Lacey Board to its employees be conferred upon those employees transferred from the Central District as well. James P.
