Synopsis: Respondent's 11 year old son received a $5,000 settlement as a result of personal injury litigation. The proceeds of that settlement were deposited with the court pending a proper application for withdrawal. The local welfare agency proposed to reduce the assistance paid to respondent under the Aid to Families with Dependent Children program because of the respondent's alleged failure to cooperate in liquidating this resource for the benefit of the child. The administrative law judge found that the respondent had refused to cooperate in obtaining access to the money which under N.J.A.C. 10:81- 3.38(b)1i and N.J.A.C. 10:81-3.39(a)3i-ii constituted a failure to cooperate. Thus, the child was found to be ineligible for future assistance until the respondent moved to liquidate the resources of the accident settlement.
