Authorizing the return of the plants, offices, afcilities and equipment of the Public Service Electric and Gas Company.
WHEREAS, Executive Order No. 23, bearing date of the 15th of May, 1950, and signed by me, did direct the Treasurer of the State of New Jersey, Walter T. Margetts, Jr., to take possession of the plants, offices, facilities and equipment of the Public Service Electric and Gas Company, a corporation of the State of New Jersey, or such part or parts thereof as might be necessary to the operation of such plants, offices, facilities and equipment in order to main of necessary and essential electric service for the people of the State of New Jersey and thereby to protect the public interest, health and welfare; and
WHEREAS, the aforesaid Executive Order was issued because the said Company and the International Brotherhgood of Electrical Workers, A.F. of L., System Council, Local Unions Nos. 853, 1335, 1134, 1338, 1320, 1345, 1368, 1329, 1350, 1330 and 1355, the representatives for collective bargaining purposes of the employees in the Electric Operating Department of said Company, had not reached a final agreement as to all conditions of employment effecting such employees through collective bargaining, and the dispute between said parties threatened to interrupt the effective operation of the Company's electric service thereby jeopardizing the public interest, health and welfare; and
WHEREAS, by the terms thereof, the said Executive Order was issued pursuant to authority conferred by Chapter 38 of the Laws of 1946, as amended by Chapters 47 and 75 of the Laws of 1947,and Chapter 14 of the Laws of 1950, and as supplemented by Chapter 308 of the Laws of 1949, in order to protect the public interest, health and welfare; and
WHEREAS, the aforesaid dispute was submitted as provided by law to a Board of Arbitration, which thereafter arrived at a unanimous decision and order concerning the issues in dispute; and
WHEREAS, the aforesaid decision and order have been accepted by both parties as the basis for an agreement in writing between them signed November 9, 1950, as a result of which the labor dispute which threatened to interrupt the aforesaid electric service has been and is now settled:
NOW, THEREFORE, I, Alfred E. Driscoll, Governor of the State of New Jersey, do hereby as of this date order and direct that any and all authority granted by me in the aforesaid Executive Order No. 23 to the Treasurer of the State of New Jersey, Walter T. Margetts, Jr., to take possesion of and operate the plants, offices, facilities and equipment above described, is hereby terminated; and I do hereby order and direct that the said property heretofore taken possession of by the said Treasurer of the State of New Jersey, Walter T. Margetts, Jr., pursuant to said Executive Order No.23, be and the same hereby is returned to its legal and rightful owner.
