EXECUTIVE ORDER #17

Executive Order #17 authorizing the employment of special counsel by the Attorney General for the Veterans Loan Authority, Division of Veterans' Services of the Department of Conservation and Economic Development, to proceed with suits on and collection of veterans' loans and in connection therewith to do all things necessary so as to obtain collection of said claims.

WHEREAS, I find as a matter of fact it is in the best interest of the Veterans Loan Authority that special counsel be employed to proceed with the collection of numerous claims arising from the purchase of defaulted veterans' loans in that (a) the budget of the Department of Law and Public Safety does not provide sufficient funds to employ the necessary additional personnel to handle these matters, (b) collection of these accounts would be more economical and effective if handled by special counsel located in the localities in which the debtors reside and (c) there are sufficient funds availbale and appropriated to the Authority to provide for the payment of any filing fees and costs that may be incurred by special counsel in the collection of these accounts, all other fees of said special counsel to be paid out of and to be dependent upon monies collected by them; and

WHEREAS, the Veterans Loan Authority, through the Commissioner of the Department of Conservation and Economic Development, ha requested the Attorney General to employ special counsel to proceed with the collection of said claims and to institute legal proceedings in connection with defaulted notes purchased and to be purchased by the Veterans Loan Authority from banks, pursuant to the provisions of the Veterans' Loan Act, chapter 126, P. L. 1944, as amended and supplemented, and has advised the Attorney General that there are sufficient funds vailable to the Veterans Loan Authority for these purposes.

NOW THEREFORE, by virtue of the provisions of chapter 20, P. L. 1944, particularly section 13 thereof, I, Alfred E. Driscoll, Governor of the State of New Jersey, hereby find that it would be in the best interest of the Veterans Loan Authority for the Attorney General to employ special counsel for the above purposes and that funds are available therefor; accordingly, I approve the employment of such special counsel by the Attorney General and, therefore, order:

1. That the Attorney General is hereby authorized to employ special counsel for the Veterans' Loan Authority for these purposes; special counsel so employed may be authorized by the Attorney General to do all things necessary and advisable in connection with said claims; the employment of such special counsel is on condition that all their fees shall be based and solely dependent upon monies collected by them in each case and that they shall reimburse the Veterans' Loan Authority for any costs advanced from monies collected in each case; and

2. That special counsel be designated and employed by the Attorney General, and that he is authorized to fix the terms of such employment, subject to the provisions of this order.

3. This order shall take effect immediately.
