VETERANS EMERGENCY HOUSING PROGRAM EXECUTIVE ORDER #15

Executive Order #15 authorizing the employment of special counsel by the Administrator of the Public Housing and Development Authority in the Department of Conservation and Economic Development for the purpose of proceedin with suits involving possession, rent delinquencies and damages.

WHEREAS, I find as a matter of fact that an emergency, requiring the employment of special counsel, exists by reason of the necessity of proceeding with the prosecution of numerous suits in connection with possession, rent delinquencies and damages under the Veterans Emergency Housing Program; and

WHEREAS, the Administrator of the Public Housing and Development Authority has requested permission to employ special counsel in the various instances in which it is necessary to proceed with suits involving possession, collction of rents or recovery of damages.

NOW THEREFORE, by virtue of the provisions of chapter 20, P.L. 1944, particularly section 13 thereof, I, Alfred E. Driscoll, Governor of the State of New Jersey, hereby find that the aforesaid situation is an emergency, as referred to in section 13 of the law above referred to and, therefore, order:

1. That the Administrator of the Public Housing and Development Authority in the Department of Conservation and Economic Development, is hereby authorized to employ special counsel as needed for the purpose of proceedig with actions and proceedings involving possession and the collection of rents and damages due, in connection with the projects constructed, operated and maintained under chapter 323, P.L. 1946, as amended and supplemented, provided that all fees and costs in connection therewith shall be chargeable to the project in connection with which the services are rendered and payments made from gross rents by the project manager; all such charges being properly allocated to the cost of operation, management and maintenance thereof; and

2. That the designation and terms of employment of special counsel in each instance be subject to the approval of the Attorney General.

3. This order shall take effect immediately.
