WHEREAS, Executive Order No.12, bearing date the 16th of August, 1948, and signed by Acting Governor John M. Summerill, Jr., did direct Harry C. Harper, Commissioner of Labor, as the representative of the State of New Jersey, to take possession of the plant, equipment and facilities of the Perth Amboy Gas Light Company, 222 Smith Street, Perth Amboy, New Jersey, and such part or parts of such plant and facilities as may be necessary for the purpose of continuing the operation of said plant so as to continue the sale and distribution of gas to the public without interruption; and
WHEREAS, by the terms thereof, the said Executive Order as aforesaid was issued by Acting Governor John M. Summerill, Jr., because there was then in progress a strike of the employees of the said Perth Amboy Gas Light Company, 222 Smith Street, Perth Amboy, New Jersey; and
WHEREAS, by the terms thereof, the said Executive Order as aforesaid was issued by Acting Governor John M. Summerill, Jr., pursuant to authority conferred by Chapter 38 of the Laws of 1946, as amended and supplemented by Chapters 47 and 75 of the Laws of 1947, in order to protect the public interest, health and welfare; and
WHEREAS, I have been advised that the employees of said plant who were actually on strike have returned to work; and that the Perth Amboy Gas Light Company, 222 Smith Street, Perth Amboy, New Jersey, and the employees engaged in the operation of said plant have, by direct negotiation, settled the disputes between them, and have agreed to such settlement in writing,
NOW, THEREFORE, I, Alfred E. Driscoll, Governor of the State of New Jersey, by virtue of the authority conferred upon me by Chapter 38 of the Laws of 1946, as amended and supplemented by Chapters 47 and 75 of the Laws of 1947, do hereby order and direct that any and all authority conferred upon said Commissioner of Labor pursuant to said Executive Order No. 2 be, and the same hereby is terminated; and I do hereby order and direct that the said property heretofore taken possession of by the said Commissioner of Labor pursuant to Executive Order No. 12 be, and the same hereby is returned to its legal and rightful owner.
THIS ORDER shall take effect immediately.
