EXECUTIVE ORDER NO. 9

WHEREAS, Executive Order No.5, bearing date of the twelfth of June, 1947, and signed by me, did direct the Commissioner of Labor of the State of New Jersey, Harry C. Harper, to take possession of the plant, equipment and facilities of the Perth Amboy Gas Light Company, 222 Smith Street, Perth Amboy, New Jersey, and such part or parts of such plant and facilities as may be necessary to be used in the operation of said plant and facilities so as to continue the sale and distribution of gas to the public without interruption; and

WHEREAS, the said Executive Order,as aforesaid, was issued by me because there was in progress a strike of the employees of the above mentioned plant, acting through their duly elected representatives, chosen for the purpose of collective bargaining, which representatives had petitioned me to excerise the power granted to me by law to seize and operate said plant, and

WHEREAS, the employees and the employer engaged in the operation of this utility have as a result of collective bargaining arrived at an understanding satisfactory to both parties and have agreed to the same in writing, as a result of which the labor dispute which caused said strike has been and is now settled.

NOW, THEREFORE, I, Alfred E. Driscoll, Governor of the State of New Jersey, do hereby as of this date revoke any and all authority granted by me in said Executive Order No. 5, above referred to, to the Commissioner of Labor of the State of New Jersey, Harry C. Harper, to seize, hold and operate the plant above described and I do hereby order and direct that the said property heretofore taken possession of by the said Commissioner of Labor, Harry C. Harper, in pursuance to Executive Order No. 5, be and it hereby is returned to the Perth Amboy Gas Light Company, the rightful owner thereof.

THIS ORDER shall take effect immediately.
