WHEREAS, Executive Order No. 4, bearing date the 7th of April 1947, and signed by me, as Governor of the State of New Jersey, did direct Harry C. Harper, Commissioner of Labor of the State of New Jersey, to take possession of the plants, offices, facilities and equipment of every nature and description used in the operation of the business of the New Jersey Bell Telephone Company within the State of New Jersey or such part or parts of each of said plants, offices, facilities and equipment to the extent it may be necessary for the purpose of continuing essential and effective operation and of furnishing necessary and essential telephonic communication to the citizens of this State, and
WHEREAS, the said Executive Order as aforesaid was issued by me because a strike had been called at the above mentioned plants by the employees thereof, acting through their duly elected representatives, and
WHEREAS, the Executive Order above referred to and the seizure thereunder in the name of the State of New Jersey was made necessary in order to protect the public interest, health and welfare of several hundred thousands of our citizens due to the fact that as a result of strikes and threatened strikes among employees engaged in the operation of the above mentioned plants who had either left their posts of employment or were threatening to do so, which action threatened to result adversely to the public interest, health and welfare of our citizenship and
WHEREAS, the employees of said plants who were actually on strike have now returned to work, and those who were not on strike but were threatening to do so, have withdrawn their threat of striking and all of said employees and their employers have submitted their differences to a board of arbitration appointed in accordance with the provisions of the statute and
WHEREAS, the said board of arbitration has filed with me its findings, decisions and orders, copies of which were likewise submitted to each of the disputants as well as the State Board of Mediation, and
WHEREAS, as a result thereof the threatened injury to the publicinterest, health and welfare necessitating the operation of these various plants by the State of New Jersey no longer exists,
NOW, THEREFORE, I, Alfred E. Driscoll, Governor of the State of New Jersey, by virtue of the authority conferred upon me by Chapter 38 of the Laws of 1946, as amended and supplemented by Chapters 47 and 75 of the Laws of 1947, do hereby return to their legal and rightful owners as of this date all of the above mentioned plants, offices, facilities and equipment which have heretofore by virtue of the above mentioned Order been seized in the name of the State of New Jersey.
